PRIVACY POLICY
§ 1. General provisions
- The policy of privacy and use of cookies on the http://www.bartergaz.pl website (hereinafter: “Policy”) has been created and adopted by BARTER S A with its registered office in Białystok, 15-281, ul. Legionowa 28, NIP: 9661388342, Regon:050835467
- Terms used in the Policy mean:
- Service: website http://www.bartergaz.pl;
- User: an entity using a publicly accessible Service;
- Owner: BARTER S A based in Bialystok, 15-281, ul. Legionowa 28, NIP: 9661388342, Regon:050835467
- Cookies: text files, sent by the Service and stored on the User’s terminal device, which the User uses while browsing the web. Files contain information necessary for the proper functioning of the Website. Cookies most often contain the domain name of the website from which they originate, the time they are stored on the end device and a number;
- In particular, the Policy aims to:
- To provide Users with information regarding the use of Cookies on the Website, as required by law, including the Telecommunications Law;
- Provide users with privacy protection to the extent that it meets the standards and requirements set forth in applicable laws.
- The Owner limits the collection and use of information about Users to the minimum required to provide services to them.
- In order to gain full access through the Service to the content and services offered by the Owner, it is advisable to accept the rules under the Policy.
- Applications include. The following legal provisions:
- Act of July 16, 2004 Telecommunications Law (Journal of Laws 2017.1907, as amended);
- Act of July 18, 2002 on the provision of services by electronic means (Journal of Laws 2017.1219, as amended);
- Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016. on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation) (OJ L 119, 4.5.2016), together with Polish data protection regulations.
§ 2. Privacy and data protection
- Data on Users are processed by the Owner in accordance with legal regulations. The personal data of Users obtained by the Owner is processed on the basis of the consent given by the User or the occurrence of another premise authorizing the processing of data according to the regulations, in particular the Regulation.
- The owner shall take special care to protect the interests of data subjects, and in particular shall ensure that the data:
- processed lawfully, fairly, and transparently for Customers and other data subjects;
- collected for specific, explicit and legitimate purposes and not further processed in a manner incompatible with those purposes;
- adequate, relevant and limited to what is necessary for the purposes for which they are processed;
- correct and updated as necessary;
- kept in a form that allows identification of the data subject for no longer than necessary for the purposes for which the data are processed;
- processed in a manner that ensures adequate security of personal data, including protection against unauthorized or unlawful processing and accidental loss, destruction or damage, by means of appropriate technical or organizational measures,
- The Owner shall apply appropriate technical and organizational measures to ensure the protection of the processed personal data appropriate to the nature, scope, context and purposes of the processing and the risk of violation of the rights or freedoms of individuals.
- The Owner strives to systematically upgrade the IT, technical and organizational measures used to protect such data, in particular, the Owner ensures that the IT protection measures are updated to allow for protection against viruses, unauthorized access and other threats emanating from the operation of the IT system and telecommunications networks.
- Any User who has made his/her data available to the Owner in any way shall be provided by the Owner with access to the data and the exercise of other rights of the data subjects in accordance with the applicable laws in this regard, including the data subjects’ rights:
- The right to withdraw consent on the processing of personal data;
- The right to information regarding their personal data;
- The right to control the processing of data, including supplementation, updating, rectification, deletion;
- The right to object to processing or to restrict processing;
- The right to complain to the supervisory authority and use other legal remedies to protect their rights.
- The Owner may process personal data by automated means, including profiling, under the terms of the Regulation. In this case, the purpose of the Owner’s actions is for marketing purposes or the need to personalize messages sent to Users (including tailoring information to the User’s needs or expectations). The user has the right to object to such processing of his/her data – this objection can be expressed by sending a message to the Owner’s address: admin@bartergaz.pl .
- A person with access to personal data shall process personal data only on the basis of the Owner’s authorization or a contract for entrustment of personal data processing and only on the Owner’s instructions.
§ 3. Cookies
- Cookies identify the User, which allows to tailor the content of the site they use to their needs. By remembering his preferences, it enables the content targeted to him, including advertisements, to be tailored accordingly. The Owner uses Cookies to guarantee the appropriate standard of convenience of the Website, and the collected data are used only internally to optimize operations.
- Cookies are used for the following purposes:
- Adapt the content of the Website to the User’s preferences;
- Optimize the use of the Website, in particular by recognizing the User’s terminal device,
- creation of statistics,
- Maintenance of the User’s session,
- Providing the User with advertising content.
- Cookies may be placed in the Service User’s terminal equipment.
- The data collected is used to monitor and see how Users use the Service in order to improve the operation of the Service providing a more efficient and seamless navigation.
- Please note that in some cases, beyond the Owner’s control, the software installed by the User on the terminal device used for web browsing (e.g. Internet browser) introduces default storage of Cookies on the User’s terminal device. Users can change their cookie settings at any time. These settings can be changed, among other things, in such a way as to block the automatic setting of Cookies or inform about their each time they are placed on the User’s final device. Detailed information in this regard is available in the settings and instructions for your software (web browser).
- The user has the option to disable or restore the collection of cookies at any time by changing the settings in the web browser.
- Changing your settings constitutes an expression of objection, which in the future may cause impediments to the use of the Service. Completely disabling the option of accepting Cookies will not mean that you will not be able to view the content posted on the Website, with the exception of those to which access requires a login.
- Failure to change the settings means that the data will be placed on the User’s terminal device (using the Website will cause automatic placement of Cookies on the User’s terminal device).
- Stored data uploaded to the User’s terminal device does not cause any configuration changes in the User’s terminal device or software installed in the device.
- The information regarding Cookies also applies to other similar technologies used within the Service.
§ 4. Final provisions
- The Policy was adopted by an order of the Owner and comes into effect on 22/05/2018. The content of the Policy may be amended in the same manner.
- Any deviation from the Policy must be in writing under pain of nullity.
- The law applicable to the Policy is the law of the Republic of Poland.
- In matters not regulated by the Policy, the relevant provisions of law shall apply.
